Terms of Service & SMS Terms

These Terms of Service ("Terms") are a binding agreement between you and NW PTY LLC, doing business as FS8 Bellevue ("we," "us"), governing your access to and use of this website, the FS8 Bellevue VIP list, and our text messaging program (collectively, the "Services"). By using the Services you agree to these Terms.

1. The VIP list

FS8 Bellevue has not opened yet. The VIP list is a free pre-opening interest list. It is not a membership, a reservation, a purchase, or a contract for services, and joining does not guarantee availability, pricing, or a spot in any presale or Founding Membership release. Opening dates, pricing, schedules, and offers are subject to change.

2. Eligibility

You must be at least 18 years old and legally able to enter into a contract to use the Services. By using the Services you represent that you meet these requirements, that the contact information you provide is accurate and current, and that the mobile number you submit belongs to you.

3. SMS / text messaging program terms

Program name: FS8 Bellevue VIP List. The program is operated by NW PTY LLC. You may separately choose to receive marketing text messages, customer-care/informational text messages, or both, depending on which SMS consent option(s) you select. Selecting one option does not enroll you in the other.

Marketing messages may include:

• Founding Membership and presale pricing
• Promotions and special offers
• Studio announcements
• Events

Customer-care/informational messages may include:

• Responses to your inquiries
• Class or appointment reminders
• Membership or class-pack communications
• Account matters
• Scheduling
• Customer service
• Operational notifications

How you consent

You provide express written consent by entering your mobile number and selecting one or both of the text message options on our sign-up forms: (1) pricing, promotions, and special offers (marketing), and (2) messages about your inquiry, classes or bookings, membership or class pack, account, and other studio service or support. You may also consent by texting us first or by giving your number to a team member and agreeing to receive texts. Consent is not a condition of purchase. Each box is optional, independently selectable, and never pre-checked; you can join the VIP list without selecting either, and your SMS choices are collected separately from any email opt-in.

Message frequency

Message frequency varies. You can expect approximately 2–8 messages per month, plus any messages sent in reply to your own.

Costs

Message and data rates may apply. Messages may be sent using automated technology. FS8 and your mobile carrier are not liable for delayed or undelivered messages.

Opting out

Reply STOP to any message to unsubscribe. You will receive one final confirmation message and then no further messages, unless you opt in again.

• Marketing: "Hi Sarah, this is FS8 Bellevue! Founding Memberships are now available with special presale pricing. Reply here if you'd like more information. Msg frequency varies. Msg & data rates may apply. Reply STOP to opt out or HELP for help."
• Customer care: "Hi Michael, this is FS8 Bellevue. Just a reminder that your class is scheduled for Saturday at 9:00 a.m. Reply here if you have any questions or need to make a change. Msg & data rates may apply. Reply STOP to opt out or HELP for help."

Carriers

Supported carriers include AT&T, Verizon Wireless, T-Mobile, Sprint, U.S. Cellular, Boost, Cricket, MetroPCS, and others. Carriers are not liable for delayed or undelivered messages.

Mobile data privacy

No mobile information will be sold, rented, or shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent are not shared with any third party for marketing purposes. See our Privacy Policy for full details.

4. Communications consent

By submitting the form you agree that we may contact you by email and, for whichever text message options you select, by promotional and/or service-related text message, subject to the SMS program terms above. Consent to receive text messages is not a condition of any purchase. Message and data rates may apply and message frequency varies. Reply HELP for help or STOP to cancel. See our Privacy Policy.

5. Presale offers

Any presale or Founding Membership offer we later announce will be governed by its own terms and by the membership agreement you sign at that time. Offers may be limited in quantity and time, may be withdrawn or modified, and are subject to studio opening. Nothing on this website is an offer to sell a membership.

6. Acceptable use

• Do not provide false, misleading, or fraudulent information.
• Do not submit a phone number or email address that is not yours.
• Do not use the Services to violate any law or the rights of others.
• Do not interfere with, disrupt, probe, or attempt to gain unauthorized access to the Services or related systems.
• Do not use automated means (scrapers, bots) to access or submit to the Services.

7. Health and fitness disclaimer

Content on this site is provided for general information and is not medical advice. Consult a physician before beginning any exercise program. Individual results vary; testimonials and transformation images reflect individual experiences and are not a guarantee of results.

8. Intellectual property

The Services, including text, graphics, logos, photography, and software, are owned by NW PTY LLC or its licensors, including FS8 brand assets used under license, and are protected by intellectual property laws. You receive a limited, revocable, non-exclusive, non-transferable license to use the Services for their intended purpose.

9. Third-party services

The Services rely on third-party providers for hosting, database storage, automation, email, and text message delivery. Your use of those providers' services is also subject to their terms and privacy policies. We are not responsible for third-party services.

10. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NW PTY LLC AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED USD $100.

12. Indemnification

You agree to defend, indemnify, and hold harmless NW PTY LLC and its affiliates from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your use of the Services, your violation of these Terms, or your violation of any law or the rights of any third party.

13. Termination

We may suspend or terminate your access to the Services, or remove you from the VIPs list, at any time and for any reason, including violation of these Terms. Sections that by their nature should survive termination will survive.

14. Governing law

These Terms are governed by the laws of the State of Washington, without regard to its conflict of laws rules. The state and federal courts located in King County, Washington will have exclusive jurisdiction over any dispute arising from these Terms or the Services.

15. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision, and continued use of the Services after a change means you accept the updated Terms.
